GENERAL TERMS

Welcome to Bookas via the website interface or mobile application. Before using Bookas or creating a Bookas account (“Account”), Users should carefully read these Terms of Service and the Privacy Policy referenced herein to understand their legal rights and obligations.
In consideration of your use of Bookas' services, you warrant that you are either of legal age to enter into binding Terms of Service and are not a person barred from receiving services under the laws applicable to your location or other relevant jurisdiction, or you have obtained prior consent from your parent or legal guardian to use the services as required and in accordance with the Terms of Service.
By continuing to use the service, you agree to confirm that you have read, understood and accepted these Terms of Service.
To meet the needs of Users, Bookas is constantly improving and developing, so the terms and conditions specified in these Terms of Service may be updated and modified at any time without prior notice to Users. Bookas will clearly announce on the website and application about such changes and additions.

EXPLANATION OF TERMS
“Bookas” is owned by Bookas Joint Stock Company, accessible via website, application or any other available access method.
“Intellectual property” means inventions, improvements, designs, processes, formulas, methods, databases, information, drawings, codes, computer programs, works, copyrighted sound recordings (now and in the future), designs of semiconductor integrated circuits, trademarks, trade marks (whether registered or unregistered), trade names and (designs of) commercial packaging.
“Personal information” is information related to identifying an individual's identity, including but not limited to the name, age, address, ID card number, phone number, email address, bank account of the User and some other information related to the User's identity.
“User” is the account owner, owner, and legal user of the account on Bookas.

BOOKAS SERVICE CONTENT
Content streaming services include audio files of content produced by Bookas, copyrighted by Bookas or permitted by copyright owners to appear on the Bookas platform.
Content portal service via RSS, in collaboration with SBOOKS, Inc. via digital contract.... These contents are managed and guaranteed by SBOOKS. Bookas is not responsible for legal or copyright issues, but will commit to support immediate handling in case of disputes.
Service to publicly host user-generated audio content that does not conflict with other parties or violate the law.

ACCOUNTS AND SECURITY
After the User completes the registration process, the User can change the account name and avatar. The account name must comply with the naming and avatar regulations and must not violate the prohibitions of these Terms of Service.
By registering for a Bookas account, the User confirms that he/she has read, understood and agreed to all the provisions of these Terms of Use. When registering for an account, the User shall provide complete and accurate information as required by Bookas and shall be responsible for the authenticity of the information provided by the Customer.
We encourage Users to name their accounts with their real names. Users are not allowed to name their accounts with unhealthy, impure, offensive, sensitive, misleading, or contrary to public morality, including but not limited to:
Names related to famous people, names of leaders, names of terrorists, fascists, criminals, etc.;
Account names must not contain words including but not limited to admin, Bookas,… to avoid using our name to scam other Users.
Some features of Bookas require Users to register and log in to use. If Users do not register and log in, they can only use the regular features. We encourage Users to register for an account to fully utilize Bookas features.
Do not use obscene, gruesome, offensive, or unethical images in any form, including but not limited to:
Images of celebrities and leaders at home and abroad;
Images that offend the honor of the State, religion, etc.;
Images of criminals, terrorists, fascists…;
Images with content that degrades or affects other individuals or organizations.
User account information must be complete, accurate and up to date. Please keep your password confidential, User should not disclose your password information to anyone. User will be responsible for all use of the service from your account. Please notify us if User suspects any unauthorized use of your account. Please ensure to update us with the latest information in User registration form so that we can contact User if necessary.
Bookas has the right to intervene, edit information or suspend service provision if it detects users violating the above.

HOW TO USE BOOKAS SERVICES
General terms of use:
Bookas does not impose any geographical restrictions on users, except in cases related to technical infrastructure that makes it impossible to access the service in the usual way. The content on Bookas is mostly intended for people aged 12 and over. Although Bookas is committed to not providing harmful content to children according to the law, we still recommend the guidance and supervision of parents or guardians for cases under 12 years old using the service.
Service package information
Depending on their needs and capabilities, Users can choose to use the following packages. Each wedding package is only for 01 user. Bookas has the right to apply necessary technical measures if any fraud is detected.

Package prices will be clearly listed on sales channels. We reserve the right to update and change service package prices from time to time, in order to ensure the original commitment for transactions occurring before the time of change. In addition, during the use of the service, Bookas also reserves the right to choose to provide all or some users or some geographic areas with promotions, incentives with different prices or free services. For these promotions, incentives, Bookas reserves the right to terminate or adjust the content without having to consult with users.
“Auto-Renew” Feature:
“Automatic renewal” is a feature that automatically activates or reactivates VIP package charges for users when the service package is due for renewal. By agreeing to subscribe to the auto-renewal utility, the User confirms that he/she authorizes Bookas or a third party to automatically deduct money from the payment card account that he/she has registered for each time the service package is due for payment.
In case you do not want to continue using the package, you can cancel this feature. The cancellation request will take effect immediately after the last day of the current subscription service period.
Please note that these auto-renewal features are features of the app store platforms provided and operated by Apple and Google, Bookas has absolutely no access to card information or payment tools, and cannot arbitrarily perform payment-related actions such as price increases, deductions or package cancellations.
Package registration and payment process
Step 1: Choose a package;
Step 2: Choose payment method through available methods on Apple Stores/Google Play or website Bookas.vn;
Step 3: Confirm payment information before payment;
Step 4: Notification of successful or failed transaction.
Note: Transactions made on the Apple Store and Google Play are collected by Apple and Google as intermediaries. Bookas cannot access, manage, store information or intervene if problems arise with these transactions.
Delivery, warranty, return and refund policy
Once Bookas' system receives a valid purchase or registration order, the system will immediately record the package and provide content to the User, except in the case of a system error or Internet connection error, the transaction processing time may be longer.
Bookas does not apply warranty or return policies for packages that the User has registered to purchase and has been used at least once. For transactions with system errors, Bookas will support users to find out the cause and handle it within 5 working days. During that time, we will try to have support policies to protect the maximum rights of users within our capacity.
We are not responsible for refunding service fees after the User has paid.

CONTENT PROHIBITED FROM EXCHANGING AND SHARING ON BOOKAS
When using Bookas services, Users are prohibited from performing certain actions including:

Taking advantage of providing, exchanging and using information on Bookas for the purpose of:
Opposing the Socialist Republic of Vietnam; harming national security, social order and safety; undermining the great national unity bloc; propagating wars of aggression and terrorism; causing hatred and conflicts between peoples, ethnicities, races and religions;
Propaganda, incitement of violence, obscenity, depravity, crime, social evils, destruction of good customs and traditions.
Absolutely do not discuss or post content about political issues.
Taking advantage of the use of Bookas to disclose state secrets, military secrets, security, economic, foreign affairs and other secrets prescribed by law in any form on Bookas.
Advertising, promoting, buying and selling prohibited goods or services or disseminating prohibited press, literary, artistic or publication works on Bookas.
Harass, swear, annoy or have any uncivilized behavior towards other Users.
Using another person's image to affect the honor, dignity, or reputation of the person whose image is used without that person's permission.
Using Bookas to collect User information, publish information and documents about the private lives of other Users.
Providing information that distorts, slanders, mocks, or damages the reputation of an organization or individual in any form (mocking, disparaging, discriminating against religion, gender, ethnicity, etc.)
Using Bookas to organize betting, gambling or other Terms of Service related to money, cash, or goods.
Illegally obstructing, disrupting, or destroying the server system; obstructing access to information and the use of legal services on Bookas.
Illegal use of passwords, encryption keys of organizations, individuals, private information, personal information and Internet resources.
Directly or indirectly use any device, software, internet site, web-based service, or other means to remove, alter, bypass, circumvent, interfere with, or circumvent any copyright, trademark, or other proprietary notices marked on the Content (such as logos) or any data control systems, devices, or other content protection measures or geographic access restrictions.
Directly or indirectly through any device, software, internet site, web-based service, or other means copy, download, stream capture, reproduce, duplicate, archive, distribute, upload, publish, modify, translate, broadcast, perform, display, sell, transmit or retransmit the Content.
Impersonating organizations and individuals and spreading fake information and false information on Bookas that infringes upon the legitimate rights and interests of organizations and individuals.
Creating illegal links to legitimate domain names of organizations and individuals. Creating, installing, and distributing malware and computer viruses; illegally accessing and taking control of information systems; creating attack tools on the Internet.
Use any program, tool or other form to interfere with the Bookas system.
Unauthorized login or attempt to unauthorized login or cause damage to the Bookas server system.
Other prohibited or restricted acts as prescribed by relevant laws.
The above actions may result in the suspension of service without any refund of payment, and the violator will be fully responsible before the law.

PROHIBITED ACCESS
We reserve the right, at all times, to prohibit or deny User access to the Bookas website, application immediately and without prior notice if we believe that the User has violated any provision of these Terms of Use, or the prohibition of access is based on our judgment, when we consider that such denial is appropriate and necessary within our authority.

INTELLECTUAL PROPERTY RIGHTS
The intellectual property rights of the content posted by Bookas belong to Bookas or are legally licensed to Bookas for use. Unless with our consent, Users are not allowed to upload, post, publish, reproduce, transmit or distribute in any form any components or create any modifications of the content provided in Bookas.
We have all rights, including but not limited to copyrights, related rights, trademarks, trade secrets, brands and other intellectual property rights in the Bookas service. The use of our rights requires our prior written permission. We do not grant you any other license, whether express or implied, to exercise the above rights. Therefore, Users have no right to use any of our products for commercial purposes without our prior written permission.
Bookas is a platform that operates on the basis of cooperation with content providers such as Publishers, Authors or content portals on the basis of mutual trust, which means the legality of the content provided by the partners is assumed. Therefore, when a dispute arises related to content copyright, Bookas will prioritize hiding the content and request the partner to present the legality of that content. If the partner cannot prove it, we will stop exploiting that content and resolve it according to the provisions of law.
The User agrees to allow us to use, disclose, adopt and modify any ideas, concepts, methods, proposals, suggestions, comments or other forms of communication that the User provides to us through the use of the service without any conditions attached.

USER RIGHTS AND OBLIGATIONS
Use Bookas services according to the registered package. Users may only use the service, not provide or resell it to any third party.
Feel free to discuss and comment on content on Bookas to share and exchange information about Bookas as well as post information related to Bookas on Bookas to discuss and comment together.
Bookas keeps your account information secure.
Freely exploit information, freely exchange and comment on the content provided by Bookas within the scope of the content specified in the Terms of Service.
Request Bookas Management Board to take measures to verify information to resolve disputes during the process of exploiting and using information and utilities at Bookas.
Be notified when Bookas Administration provides information upon request by a government agency.
Be responsible for the content of information that you store, provide, transmit on social networks, and disseminate information through direct links that you establish.
Keep account information confidential, if the above information is disclosed in any form, the User must accept the risks that arise. Bookas will base on the information available in the account to decide the account owner if there is a dispute and we will not be responsible for any losses that arise.
Immediately notify Bookas of any unauthorized use of your account or password or any other breach of security. You also ensure that you exit from your account at the end of each session.
Users may be subject to administrative penalties and criminal prosecution if you violate copyright, related rights and other intellectual property rights when you use products that violate Bookas' regulations.
Users must strictly comply with the provisions on prohibited behaviors and information exchange content as stipulated in these Terms of Service. If one or more behaviors are violated, depending on the severity of the violation, Bookas will permanently block the account and may request the authorities to prosecute you before the law if necessary.
Comply with these Terms of Service and relevant laws.

RIGHTS AND OBLIGATIONS OF BOOKAS ADMINISTRATION BOARD
Provide services in accordance with the law.
During the use of the service, if the User violates any provision of these Terms of Service, we have the right to terminate or block the account without your consent and without any liability to you.
When detecting violations such as using cheats, hacks, spreading prohibited content or other errors, Bookas has the right to use the information you provide when accessing to transfer to the competent authorities for settlement according to the provisions of law.
We have the right to refuse to support and resolve accounts with incorrect or incomplete registration information as prescribed and accounts that violate account security responsibilities.
Appropriate measures will be taken when violations of prohibited content are detected as set out in these Terms of Service. Depending on the nature of the incident, the level of impact and severity, we will take appropriate action. Bookas' decision is final and the User agrees to comply.
Public Terms of Service.
Responsible for supporting Users during the use of Bookas services.
Responsible for ensuring the confidentiality of Users' personal information, informing Users of their rights, responsibilities and risks when storing, exchanging and sharing information online.
Ensure the User's right to decide when allowing his/her personal information to be provided to other organizations, businesses, and individuals.
Do not proactively provide public information with content that violates legal regulations on management, provision and use of internet services and information on the network.
Coordinate with competent state agencies to remove and block information containing content that violates legal regulations on management, provision and use of internet services and online information upon request.
Provide personal information of Users related to terrorist activities, crimes, and violations of the law when requested by competent state agencies.
Receive and resolve customer complaints arising during the use of Bookas, however we only support, receive and resolve accounts with complete, honest and accurate registration information.
Comply with these Terms of Service and relevant laws.

LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES
We will not be responsible for any system problems in case the system is temporarily suspended for maintenance, periodic upgrades, unexpected repairs or force majeure.
Access to and use of the Bookas website/application is entirely at the User's own risk. Bookas is for personal use only and we make no representations or warranties of any kind, expressed or implied, including but not limited to any warranties of merchantability or fitness for any particular purpose.
User posts and images may be objectionable, illegal, inaccurate, or inappropriate. Bookas is not responsible for any of these posts and images. The content posted does not reflect our views or policies. We have the right, but not the obligation, to monitor and limit or remove content posted unless we have reason to believe that the content posted violates these Terms of Service or the law.

RULES FOR MANAGEMENT AND PENALTIES FOR USER VIOLATIONS
Principles for Users
Users who violate the Terms of Service will be subject to corresponding penalties as determined by Bookas depending on the severity of the violation.
In case the User's violation is not specified in these Terms of Service, depending on the nature and severity of the violation, Bookas will unilaterally and fully decide on the appropriate penalty.
Penalties:
■ Penalty 1: Block account for 7 days;
■ Penalty 2: Block account for 15 days;
■ Penalty 3: Block account for 30 days or permanently lock account.
Forms of punishment
Penalty 1: 7-day account blocking applies to but is not limited to the following actions:
■ Attack, distort, or insult the dignity of other Users.
■ Intentionally luring the User community to join the Community Room with false views and violating cultural ethics.
Penalty 2: 15-day account blocking applies to but is not limited to the following actions:
■ Communication behavior: Mild pornography, chat spam, inciting other Users to other Bookas channels to cause trouble or propagate violating information.
■ Invasion of privacy: Using other people's personal images, publicizing other people's personal documents and information such as identity, address, phone number without consent, and making harassing phone calls or inciting others to harass.
■ Attacking others: Using images, information, audio or video, insulting, providing distorted information, slandering, mocking, or damaging the reputation of organizations or individuals.
■ Copyright infringement: Stealing content from channels, copying or quoting without permission to use other people's copyrights.
Penalty 3: 30-day account blocking or permanent lock is applied including but not limited to the following actions:
■ Users who take advantage of Bookas to sabotage the Socialist Republic of Vietnam. This behavior includes but is not limited to users who set their personal User names in the community room to be the same as great people, national heroes, party and state leaders, or users who use images, videos, statements, chats... containing information discussing political issues or revealing state secrets of the Socialist Republic of Vietnam.
■ Pornographic information, images, videos: Users post pornographic images, audio, videos, sex chat or post information about live sex chat room addresses, pornographic videos, or promote pornographic content.
■ Betting and gambling information: Taking advantage of Bookas, users post information, images, audio, and video content containing information to organize betting, gambling, or Terms of Service related to money, cash, and objects.
■ Spreading fraudulent information: Using text, images, audio or video containing fraudulent information: impersonating official or organizations, individuals; cheating, defrauding other people's property.
■ Destroying the Bookas system: Users take advantage of the product to infiltrate the server system to destroy the product or hinder access to information. Users use technical tools to increase activity points, items or to hang up, spam chat.
■ Using the community room to entice the organization to hold actual meetings outside to commit illegal acts.

RISKS WHEN STORING, EXCHANGING AND SHARING INFORMATION ON THE INTERNET
Many Internet Users easily reveal information on their personal pages. Information that can be revealed such as email addresses, birth dates or phone numbers can cause you to be harassed, abused and impersonated online.
Many people do not realize that once information is shared online, it becomes public information. Even if a status update is shared with just one person or a group of people, the User has no control over what those people will do with that information. On the other hand, any information shared online can be considered public information and from being private information, it will be shared and disseminated widely.
Within our scope, we will ensure the maximum protection of the User's personal information, however, in an Internet environment vulnerable to attacks and infringements, it is inevitable and we will not bear any responsibility arising in the above cases if it is caused by the user's negligence.
For Book content purchased individually by users, the right to use Bookas' platform to access purchased content is perpetual.

COMPLAINT AND DISPUTE RESOLUTION MECHANISM
Any dispute arising during the use of Bookas will be resolved according to the current laws of the Socialist Republic of Vietnam.
Any complaints arising during the use of Bookas must be sent to Bookas immediately after the event giving rise to the complaint occurs: [email protected]
Bookas will base on each specific case to have a suitable solution. When exercising the right to complain, the complainant is obliged to provide documents, evidence, and grounds related to the complaint and must be responsible for the content of the complaint, documents, evidence, and grounds provided by him/her according to the provisions of law.
Any dispute shall be resolved by arbitration at the Vietnam International Arbitration Center (VIAC) in accordance with the arbitration rules of this Center.
You agree to defend, indemnify and hold Bookas harmless from and against any and all liabilities, claims, damages, costs and expenses including but not limited to legal fees, attorneys' fees, consultants' fees relating to or arising from your breach of the Bookas service.

COLLECTION OF PERSONAL INFORMATION AND POLICY FOR PROTECTING USERS' PERSONAL INFORMATION
Specifically stated in the Privacy Policy publicly posted on the website and application.

EFFECT OF TERMS OF SERVICE
The terms and conditions set forth in these Terms of Service are set forth on the website/application and may be updated or modified at any time without prior notice to the User. Bookas will clearly announce such changes and additions on the website and application.
In the event that one or more provisions of these Terms of Service conflict with the provisions of Vietnamese law, that provision will be amended to comply with the current legal provisions, the remaining provisions of the Terms of Service will remain valid.
The User agrees that these Terms of Service and any dispute arising from the User's use of our services shall be resolved in accordance with the applicable laws of the Socialist Republic of Vietnam. By registering or using our services, the User implicitly agrees and complies with all provisions of Vietnamese Law.
